The laws regarding sex offenses in Florida are complex to say the least. In Florida, the legal age of consent is 18. However, Florida has a "Romeo and Juliet law," which was designed to help young couples close in age. The Romeo and Juliet law can be used to prove these relationships are not a sex crime. If the two people involved are mutually consenting to the relationship and if the older person is no more than exactly 4 years older than the younger person, the Romeo and Juliet law could be applied.
Sex offenses are arguably the most difficult charges for one to deal with. There is a stigma to sexual offenses, but the truth of the matter is that all crimes have two sides to the story -- regardless of the nature of the crime. False accusations are particularly common when it comes to sex offenses. It's possible that a former spouse accused you of a sex crime to get custody of your child.
If you are 18, you may have been accused of statutory rape by your partner's parent, and the Romeo and Juliet law could help your case. There are countless situations you could be dealing with. The most important thing to remember is that you are innocent until proven guilty -- NOT the other way around. Contact me, Jonathan Blecher, P.A., to schedule your complimentary consultation.
